Due to the variable nature of our cases, we advise clients to contact us directly for questions about our legal fees. However, there are fixed prices available for some aspects of our work including Will writing and motor-related offences which you can find detailed below.

      Probate Legal Fees

      Probate Full Administration – We will obtain the documentation needed to sell or transfer assets, advise you on your duties and liabilities as you deal with Probate, and apply for the Grant of Probate on your behalf. We will then pay off all debts and disburse the estate to the beneficiaries in a timely fashion. A Full Administration typically takes 10-12 months.

      For Full Administration, we offer a fixed fee of 1% of the gross value of the estate with a minimum fee of £2,400.00 plus VAT.

      Fees for this service are normally paid from the assets held by the Estate. No ‘upfront’ payments are typically required.

      Probate Grant only – We complete the Probate Application and Inheritance Tax return. We draft a Statement of Truth to support your application for the Grant of Probate. We make the application to the court and obtain the Grant.

      It usually takes one month from the date of instruction to be ready to apply for a Grant of Probate. The courts typically take 6-8 weeks to release the Grant.

      We offer a fixed fee of £1,250.00 plus VAT and disbursements for simple estates (estates requiring the IHT 205 and IHT 217 tax returns).

      We offer a fixed fee of £2,400.00 plus VAT and disbursements for complex estates (estates requiring the IHT 400 tax returns).

      Deed of Variation – £350 plus VAT.

       

      Lasting Power of Attorney Legal Fees

      LPA document only without registration at the Office of the Public Guardian – £300 + VAT

      Single Property and Financial Affairs LPA or a Health and Welfare LPA – £300 + VAT

      Both types of LPA – £600 + VAT

      Husband & Wife Property and Financial Affairs LPA or a Health and Welfare LPA – £600 + VAT

      Husband & Wife both types of LPA (4 documents in total) – £900 + VAT

      Each LPA needs to be registered with the court, the Office of Public Guardian before it can be used. The court fee is currently £82 per document and is payable directly to the court.

      If the person who is making the LPA (the donor) receives certain means-tested benefits when you apply to register it, you will not have to pay anything – this is called an exemption.

      If the donor’s income before tax is less than £12,000 a year, you will only have to pay half – this is known as a 50% remission.

       

      Application to the Court of Protection

      We always advise that you make Lasting Powers of Attorney whilst you have the mental capacity. A Deputy application is inevitably more costly than preparing Lasting Powers of Attorney as well as more time-consuming. There are Solicitors’ costs, court fees and other disbursements.

      The current court application fee is £365 for each type of Deputyship (Property and Affairs and Health and Welfare).
      An additional fee of £485 could become payable if the court decides that a hearing is required which can, of course, carry further legal costs.

      You may be asked to set up a security bond before you can be appointed as the Property and Affairs Deputies (unless the court decides otherwise).

      You should also consider the annual general supervision fee which is usually £320 however it can be as little as £35 if you are managing property which is valued less than £210,000. You can have a reduction in the amount of supervision fee if you are on low income.

      It is a requirement that mental capacity assessments are undertaken. These can cost in the region of £500 each. They will be part of disbursements. The security bond is an insurance policy and as rough guidance can cost around £500 (where the property is worth around £250,000 mark).

      Exemption or remission of the Court application fees apply to those who are on a low income, or in receipt of certain means-tested benefits. The quoted fees may vary depending on the complexity of the case and the number of Deputies required.

      Motoring Offences Legal Fees

      Free Initial Telephone Discussion – This Initial Telephone Discussion is free. The call helps us to assess your case and we will let you know if it is a case that we will be able to help you with.

      Initial Advice – £300 + VAT – Our initial advice includes: receiving your papers, considering your case and advising you either by telephone or at our office. This will include initial advice on possible defences and a likely sentence, if pleading guilty. This includes our conference time of 30 minutes.

      Written Guilty Plea – £500 + VAT – Includes the above, as well as the management of your case and bringing it to a conclusion by submission of a written guilty plea. This will additionally include preparing a letter in mitigation and communicating with the court on your behalf.

      Court Appearance: Guilty Plea – £500 – £1,000 + VAT – As above; also the cost of representing you at court on a guilty plea, [assuming only one hearing] this will include meeting you at court and dealing with your case as a priority on the day. Includes our conference time of 1 hour.

      Court Appearance: Exceptional Hardship Cases – £1,000 – £2,000 + VAT – Ordinarily anyone who receives 12 or more penalty points via ‘totting up’ procedures is liable for disqualification from driving. However, it may be possible to avoid a disqualification by successfully arguing ‘exceptional hardship’ before the court.

      Our team can provide expert representation in such cases. This includes a conference call as required and the preparation of written submissions to the Court to assist your evidence, attending upon you on the day at court and presenting your case to the court. We will advise you on your rights of appeal, if necessary.

      Court Hearings: Special Reasons Argument – £1,000 – £3,000 + VAT – In certain road traffic matters it can be argued that despite an individual’s guilt to the offence there are ‘special reasons’ whereby the subsequent penalty can be avoided altogether or reduced. Our team can provide expert representation in such matters, which can be very technical. Our services would include initial consultations, preparatory work for the hearing and representing you at the hearing.

      Court Hearing: Not Guilty Trial – £1,000 – £5,000 + VAT – We are regularly instructed to challenge cases at trial. Typically, these involve costs of £2,000 + VAT and the costs of any expert’s reports. In every trial case we will provide you with a detailed estimate of costs.

      Please note that the above fees are legal fees and exclude disbursements for expert reports and medical records. Furthermore, these fees are purely for indicative purposes and are subject to a formal consultation and assessment of your case.
